Subject: SHOW CAUSE NOTICE UNDER SECTION 7(a) OF THE PUNJAB EMPLOYEES EFFICIENCY, DISCIPLINE AND ACCOUNTABILITY ACT, 2006 ON ACCOUNT OF WILFUL ABSENCE FROM DUTY. WHEREAS, you were granted 730 days (2 years) leave in following rnanner: - i. 182 days earned leave With effect from 15.6.2011 to 15.12.2011 on half average pay. ii. 548 days leave with effect from 16.12.2011 to 14.6.2013 as E.O. L. without pay. 2. AND WHEREAS, after availing 730 days above said leave, you have requested for further, 1096 days (3 years) extension in EOL, Without pay w.e.f. 15.6.2013 vide application dated 7.6.2013 which was examined and you were informed that according to the provision of rules, a Govt. servant is entitled for 2 years (730 days) EOL without pay having less than 10 years service and your service is less than 10 years. Therefore, your request for 3 years (1096 days) extension in EOL without pay is not covered under the rules. You were informed that out of 730 days, you have availed 91 days leave without pay (EOL) w.e.f. 30.12.2010 to 30.3.2011 and 548 days leave without pay (EOL) w.e.f. 16.12.2011 to 14.6.2013 and only 91 days EOL is available in your credit, Further, if you want to avail remaining 91 days EOL, then furnish a new application to proceed further in the rnatter vide this Departrnent's letter of even-numberdated 17.6.2013. 3. AND WHEREAS, in response to this Department's letter of even number dated 17.6.2013, you requested for grant of remaining 91 days EOL without pay w.e.f. 15.6.2013 to 13.9.2013 vide application dated 20.6.2013 which was granted vide this Department's order of even number dated 17.7.2013. 4. AND WHEREAS, after availing the said EOL, you have again requested for extension for 1096 days EOL vide application dated Nil which, was examined and you were informed that your request for 1096 days extension in EOL w.e.f 14.9.2013 to 13.9.2016 is not covered under the rules and you were directed vide this Department's letter of even number dated 7.10.2013 to join your duties immediately otherwise disciplinary proceedings on account of willful absence from duty under PEEDAAct, 2006 will be initiated against you. However. after lapse of almost 1-1/2 month. you have failed to do so. Hence, the charge of willful absence from duty with effect from 14.9.2013 stands established against you. 5. NOW, THEREFORE you are hereby called upon to show cause in writing within 15 days of receipt of this notice, as to why one or more of the major penalties as prescribed Under Section 4(1)(b) of the Punjab Employees Efficiency, Discipline and Accountability Act 2006 may not be imposed upon you? 6. Your reply should reach the undersigned within fifteen (15) days and also intimate if you Ash to be heard in person, failing which it shall be presumed that you have no defence to offer and do not wish to be heard in person, therefore, an ex-parte decision shall be taken accordingly. 7. In case, you desire to consult any record, on the basis of which aforesaid charges are based or is relevant to the aforesaid charges, you may do so with prior arrangernent with this office within the stipulated period.
