Phone: 091-9210276 9211140 Fag: 091 9210236 AUCTION NOTICE FOR GEMSTONES Sealed Tenders are invited for the grant of ten years mining kase (inclusive of royalty) for the following Gemstone bearing areas (renewable in terms as specified in the mining lease agreement). The Sealed Tenders shall be opened in office of the Director General Mines and Minerals, Khyber Road Peshawar on 27-02-2014 at 10:00 AM. Tenders mentioning the name of the Company, Firm or individual with complete address, telephone and fax number shall be considered. The foreign investors (company, firm or individuals) are also entitled to pariicipate for auction provided firms, companies are incorporated in Pakistan. 2. A certificate from any scheduled Bank of Pakistan clearly indicating the financial soundness / credit worthiness of the company or firm/individual to be submitted along with the tender documents. The Bank certificate alongvvith Bank Statement of accounts focal least three calendar years having a closing balance of at least Rs.10.00 million Will be required and presented alongwith tender fomi failing which the bid will not be accepted. , The successful bidder will be required to submit a credit worthiness certificate issued by any scheduled Bank of Pakistan for an amount US$ 1.00 million or its equivalent in Pak. Rupees clearly indicating the consent of Bank Authorities for sanctioning credit facility to the party when required. 4. In case of applications from foreign companies/fimil individuals, they shall get themselves duly registered / incorporated with Board of Investment and or Security and Exchange Commission of Pakistan before the bid is offered and to present the certificate of registration along with bid documents. 5. In case of already existing company, firm, an audited statement of accounts for the previous 3-years is required. 10 0000 of new company, firm or individual, a financial soundness certificate from any Banking Institution Will be required and presented within seven days of the acceptance of the bid failing which the bid shall stand rejected. 6. National Tax Number and Computerized N.I.C. of the individual, Company / Firm its Directors / Managing Partners and parties in individual capacity shall be submitted within. seven days of the acceptance of bid. 7. Details of experience of parties (individual/company firm or any of its Directors) in the field of mining exploration in past or present. Involvement held in gemstone business be highlighted. List of qualified Mining Personnel with bio-data address, qualification, and experience of the company / firm shall be provided within one month of the acceptance of bid. I. Details of necessary (mining machinery, earth moving and processing), which could be utilized for mining operations. 9. The bidder shall submit prescribed tender form and a plan of the area for each block. The tender form are available in the Directorate @Rs. 50,000/- (non refundable). The bidder is required to submit Deposit at Call (refinidable) @2% of the bid in favour of the Director General Mines and Mineral Khyber Road, Peshawar. 10. The successful bidder shall be required to deposit Fts.20,000/- as application fee, Rs.7,000/- as Departmental Demarcation Fee and Rs.1,500/- as cost of plan (non refundable), submit Domicile, Assets and Credential Certificate along with photo copy of Computerized National Identity Card (issued by NADRA) and complete other formalities as required under the Khyber Pakhtunkhwa Mining Concession Rules-2005 for the gmnt of Mining Lease. 11. The successful bidder shall deposit Security @ 10% of the bid money on signing of the agreement with the Government. In normal course, the security will be refundable on successful completion of the lease period. However, in case of any default or breach of the terms and conditions of the agreement, the security may be forfeited in favour of the Government. The security shall be deposited in Khyber Pakhtunkhwa Treasury (in cash) under the Provincial Mineral Security Head of Account or in the shape of National Savings Certificates pledged in the name of "Director General Mines & Minerals, Khyber PalchtunIchwa" which shall ensure refimd of the some in normal (default-less) completion of lease tenure in terms of the Mining Lease Agreement executed between the parties. The security (Principal amount) will be free of any mark-up or interest to be paid to the depositor in case when security is deposited in the Khyber Pakhtunkhwa Treasury, i.e in cash. 12. In case of non payment of security or down payment / surface rent within the prescribed period, the 2% eamest money deposited by the successful bidder shall be forfeited in favour of the Government. In normal course, it would be refunded or adjusted against the payments becoming due. 13. Withholding Tax @ Rs. 5% shall be deducted in lump-sum at the source of total bid amount. The successful bidder shall deposit the amount within seven days failing which the bid shall be rejected. 14. The successful bidder shall pay 10% of the accepted bid money as Down Payment within 10-days from the date of approval of the bid. The remaining bid money shall be payable in equal yearly installments i.e. @ 10% of the Bid money per year. to case of nonpayment of the installment within I5-days when it becomes due on the expity of each year, the Licensing Authority will be at liberty to cancel the lease and to forfeit the security amount. 15. That besides the auction money, the successful bidder will also pay an additional 5% of the total Bid amount towards social uplift/ contribution of the area/ locality in terms of Rule-141 of the Khyber Pakhtunkhwa Mining Concession Rules-2005 through the Committee constituted for it. This contribution will be spread over annually for the Lease period (Ten Years), and paid each year in advance. 16. The lessee shall pay surface rent/ land compensation to the lawful/legitimate land owners of the allotted area, on the rates as determined by the Licensing Authority/Surface Rent Commit.. The same agreement/amount shall also be registered in the local court afloat to avoid any legal complications. The Licensing Authority/ Surface Committee will settle the surface rent with the legal land owners at the initial stage, before its formal registration. 17. The successful bidder shall have to work the area in accordance with the Khyber Pakhtunkhwa Mining Concession Rules-2005 and instruction of Licensing Authority issued from time to time. 18. The lease shall be for a period of 10-years and shall take effect from the date of issue of Allotment Letter by the Licensing Authority. The lessee shall also execute a Mining Lease Agreement/Deed with the Licensing Authority within one month from the date of issue of Allotment Letter. 19. The areas are being offered for auction on "as is where is" basis. 20. The Director General Mines and Minerals, Khyber PalchtimIchvva, Peshawar shall have the discretion to accept or reject any bid or all bids without assigning any reason thereof. 21. Incorrect information/documents supplied will render the company, firm or individual disqualified. 22. The last date of obtaining the knder forms is 21-02-2014(04:00 PM).
